Terms of Service
These Terms of Service ("Terms") govern your use of the VaxShield mobile application ("the App"), operated by an individual developer (the "Developer," "we," "us," or "our"). By downloading, installing, or using VaxShield, you agree to these Terms. If you do not agree, please do not use the App.
1. What VaxShield does
VaxShield helps parents and guardians record, organize, and receive reminders about the immunization and vaccine records of their children and family members. The data you enter is stored in your own Apple iCloud account and remains under your control. We do not host, access, or manage your records.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use VaxShield. The App is intended for use by parents and guardians, not by children. By using the App you represent that you meet these requirements.
3. Your responsibilities
- You are responsible for the accuracy of the information you enter, including vaccine dates, doses, and reminders.
- You are responsible for maintaining the security of your device and Apple account.
- You agree to use VaxShield only for lawful, personal, non-commercial purposes.
- You agree not to misuse, reverse-engineer, interfere with, or attempt to gain unauthorized access to the App or its systems.
4. Not medical advice
VaxShield does not replace professional medical care. Vaccine schedules, eligibility, and recommendations vary by individual and change over time. Reminders generated by the App are conveniences only and may be incomplete or inaccurate. You should always verify immunization needs and timing with a licensed healthcare provider and official health authorities. We are not liable for any health outcome related to your use of, or reliance on, the App.
5. Subscriptions, billing, and payments
VaxShield may offer optional paid subscriptions or features. All purchases are made through Apple's App Store and are subject to Apple's terms. Specifically:
- Payment is charged to your Apple account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel subscriptions in your device's Settings › [your name] › Subscriptions.
- Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
We do not process or store any payment information. All billing, refunds, and payment disputes are handled by Apple in accordance with Apple's policies. Refund requests should be directed to Apple.
6. Your data and Apple's services
VaxShield relies on Apple's iCloud, CloudKit, App Store, and StoreKit. Your data is stored in your Apple account and governed by Apple's terms and privacy policy. We are not responsible for the availability, security, or performance of Apple's services, or for any loss of data resulting from your Apple account, device, or iCloud settings. Please keep your own backups where possible. Our handling of information is described in our Privacy Policy.
7. Intellectual property
The App, including its design, code, text, and graphics, is owned by the Developer and protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App on Apple devices you own or control, in accordance with the App Store Terms of Service. You may not copy, modify, distribute, sell, or lease any part of the App.
8. Apple App Store terms
You acknowledge that these Terms are between you and the Developer, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure of the App to conform to any warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that reminders will always be delivered on time.
10. Limitation of liability
To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or health outcomes, arising out of or related to your use of (or inability to use) the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for the App, if any, in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, or expenses arising from your misuse of the App or violation of these Terms.
12. Termination
You may stop using the App at any time by deleting it. We may suspend or terminate your access to the App if you violate these Terms. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
13. Governing law
These Terms are governed by the laws of the United States and the State of Ohio, without regard to its conflict-of-law rules. Any dispute will be resolved in the courts located in that state, except where applicable law provides otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide notice within the App. Your continued use of VaxShield after changes take effect constitutes acceptance of the revised Terms.
